A Nyeri Court has sentenced a man to six years in prison after he was found guilty of having sex with a donkey.
James Mwangi committed the beastly act on April 26, 2013 at Ruring’u area in Nyeri County.
According to the Chief Magistrate Wilbroda Juma, witnesses presented by the prosecution had given enough evidence regarding the case to enable the court make a ruling.
Mrs Juma said that the donkey’s owner Mr Peter Mathenge was one of the witnesses.
Mathenge had testified that on the said date, he had left the donkey with its young ones grazing and was later informed by a neighbour that his donkey had been abused by Mwangi.
He had further testified before the court that on visiting the scene, he found a condom and carried it to the nearest police station to report the matter.
The magistrate said that police officers acted on the information and interviewed an eye witness who identified himself as Mr Ng’ang’a and who said that he saw the accused having tied the donkey’s legs and mounting on it.
When the accused realised that he had been seen, he tried pulling up his trousers while attempting to escape from the scene but was arrested.
On further examination by the police officers, a condom was found inside the donkey’s reproductive parts.
In mitigation, the accused said that he is a young man with a bright future and has never committed such an offence before.
He therefore prayed for a lenient sentence so that he could become a person who can be depended on later in life.
The prosecutor Cathrine Murugi told the court that the accused was a first offender and had no previous criminal records.
The magistrate said while the court had noted the plea made by the accused, his case would serve as a lesson to others owing to the prevalence of cases of people committing unnatural acts with animals.
“You have been found guilty of committing the offence and will therefore serve a six years imprisonment,” said Mrs Juma.
